Income tax in Texas
Texas voters have spent the last several years bolting the door on personal taxation, one constitutional amendment at a time. Article VIII, Section 24-a — added November 5, 2019 — prohibits the legislature from imposing a tax on the net incomes of individuals, including an individual's share of partnership and unincorporated association income. Voters went further in November 2025 by adding Section 24-b, which bars a tax on the realized or unrealized capital gains of an individual, family, estate, or trust — investment profit rather than wages — while expressly preserving property, sales, and use taxes; a 2023 amendment had already prohibited a wealth tax. What funds the state instead shows up at the register and at the wellhead: a 6.25% state sales and use tax that local jurisdictions can lift to a combined 8.25% maximum, alongside a 4.6% oil production tax and a 7.5% natural gas production tax.
